The terms that govern your use of the Cybernion website and products.

Scope
These terms apply to your use of cybernion.com.au, Cybernion Cloud, Cybernion Local and related product materials unless a separate written agreement with Cybernion Pty Ltd says otherwise. If a signed order form, statement of work, master services agreement or licence agreement applies, that agreement takes priority for the parts it covers.
Product use
Cybernion products are provided for security assessment, uplift, evidence management, reporting and related governance work. You must use them lawfully, keep account and licence credentials secure, and ensure that users have the authority and competence required for the work they perform in the product.
Confidential and classified information
You are responsible for deciding whether information entered into, uploaded to, exported from or sent to Cybernion is confidential, sensitive, regulated or classified. You must not provide classified information, security classified government information, secrets, credentials or highly sensitive client evidence to Cybernion through ordinary website forms, email or unsupported channels. Any handling of classified or specially protected material must be agreed with Cybernion in writing before the information is provided.
Cybernion Cloud
Cybernion Cloud is the hosted web platform. You are responsible for the accuracy of information entered by your users, the legality of the data you process, user access decisions, client permissions and any approvals required to use a cloud service for the relevant engagement.
Cybernion Local
Cybernion Local is designed to run locally on your machine. You are responsible for controlling the machine, downloaded file, licence token, assessment files, exports, backups and any transfer of those files. Cybernion Local does not remove your obligation to follow your client, agency, classification, contractual or legislative handling requirements.
No automated assurance outcome
Cybernion products support assessment and uplift workflows. They do not certify compliance, guarantee authorisation, replace professional judgement, or guarantee acceptance by a regulator, government agency, client, auditor or authorising officer.
Intellectual property
The Cybernion name, logo, website, product design, software, documentation, templates and content are owned by Cybernion or its licensors. You receive only the rights expressly granted to you. You must not copy, resell, reverse engineer, scrape, bypass licence controls or use Cybernion content to build a competing product.
Third party and framework content
Some frameworks, standards and references are owned by third parties. Cybernion may provide links, mappings, summaries or lawful excerpts where appropriate, but your organisation remains responsible for holding any licences needed to use third party standards or content.
Availability and changes
We may update, improve, suspend or change products and website content from time to time. We aim to operate professionally and securely, but we do not promise that the website or hosted products will be uninterrupted, error free or free from all harmful components.
Limitation of liability
To the extent permitted by law, Cybernion is not liable for indirect, consequential, special or punitive loss, loss of profit, loss of opportunity, loss of data, or loss arising from use of or reliance on the website, products, outputs or general content. Any liability that cannot be excluded is limited to the maximum extent permitted by law.
Governing law
These terms are governed by the laws of New South Wales, Australia, and you submit to the courts of that jurisdiction.
